In an 8-day trial in January of 2014, Mark Budzinski defended a difficult LASIK surgical case against a self-proclaimed plaintiff’s LASIK attorney from New York. Plaintiffs alleged the defendant physician was negligent in offering the procedure in the first place in light of his contraindications for the surgery. Plaintiffs alleged significant visual difficulties in both eyes and a need for corneal transplant as a result. They requested more than 1.5 million dollars in damages from the jury. After less than two hours the jury returned a defense verdict on every question to include a finding of no negligence, and answering the statute of limitations questions in favor of the defendants. The Court also had the jury answer nine different damage questions. They entered $0 for each of the nine categories of damages.
